A BILL to amend article one, chapter thirty-six of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated
section twenty-five, relating to estates in property;
creation of estates generally; and eliminating the creation
of acquisition of interests in real estate by adverse
possession.
Be it enacted by the Legislature of West Virginia:
That article one, chapter thirty-six of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
twenty-five, to read as follows:
ARTICLE 1. CREATION OF ESTATES GENERALLY.
§36-1-25. Elimination of acquisition of property rights by adverse possession.
Notwithstanding any other provision of law to the contrary,
on and after the effective date of this section, no right or
title to real estate may be acquired by adverse possession.
NOTE: This bill eliminates the acquisition of property
rights in real estate by adverse possession.
